This Privacy Policy explains how Accor collects, uses, discloses and otherwise handles personal information in connection with the ALL Accor Creator Academy ("Programme") and any creator partner agreement entered into following certification under the Programme ("Creator Partner Agreement").

1. About this policy

This Privacy Policy is issued by AAPC Limited and its affiliates (as that term is defined in the Corporations Act 2001 (Cth)), trading as Accor (ABN 87 009 175 820) ("Accor", "we", "us", "our"). Our registered address is Level 23, 1 Bligh Street, Sydney NSW 2000.

We are committed to handling your personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and, to the extent applicable, Accor's global customer data protection charter, available at all.accor.com/a/en/information/data-protection.html (the "Accor Data Protection Charter").

Capitalised terms used in this Privacy Policy have the meanings given to them in the Programme Terms and Conditions available here: https://www.accorcreatoracademy.com/all-accor-terms-conditions. By applying for and participating in the Programme, you acknowledge that your personal information will be collected, used and disclosed as described in this Privacy Policy. If you do not provide the personal information we request, we may not be able to assess your application, admit you to the Programme, or deliver Programme benefits and opportunities to you.

2. Overview

This Privacy Policy applies to the collection, use and disclosure of personal information in connection with the Programme and any Creator Partner Agreement, from the point of application through to the conclusion of the applicant's or Participant's involvement in the Programme and, where applicable, the expiry or termination of any Creator Partner Agreement.

3. Collection of personal information

(a) We collect the following personal information through the Programme application and onboarding process: (i) your full name, email address, date of birth or age, country of residence, and state or region; (ii) social media handles and platform details; (iii) any personal information contained in your responses to application questions; (iv) information regarding your employment or business affiliations (including any association with a Competitor); and (v) device information.

(b) We may also collect additional information during the Programme itself, including: (i) analytics data you provide in respect of your content (such as reach, engagement and impressions); (ii) feedback you provide; and (iii) information gathered during Creation Week.

4. Collection of sensitive information

In connection with Creation Week, we may collect sensitive information (as defined in the Privacy Act 1988 (Cth)), such as dietary requirements or health and accessibility needs, where you choose to provide this information to us. We will only collect sensitive information with your consent and will use it solely for the purpose of facilitating your participation in the relevant Programme activity.

5. Indirect collection

In addition to personal information collected directly from you, we may collect personal information about you from publicly available sources, including your public social media profiles and content. This information may be collected with the assistance of automated tools as part of the application review process. Final decisions on applications are made by Accor personnel.

6. Anonymity and pseudonymity

Due to the nature of the Programme, which requires verification of your social media identity and follower count, Participants are unable to remain anonymous or use a pseudonym. This is a requirement of the Programme application and participation process.

7. Collection through the Programme website

The Programme landing page, application portal and any associated learning management system may collect personal information from you when you interact with those platforms. This includes information you submit through forms as well as information collected automatically through the use of cookies and similar tracking technologies. Usage data such as page views, navigation paths, and device and browser information may be collected automatically when you access the Programme platforms. You can manage cookie preferences through your browser settings.

8. Purposes of collection, use and disclosure

We use your personal information for the following purposes: (a) assessing and processing your application, including verifying that you meet the eligibility criteria; (b) detecting and preventing fraudulent applications or misuse of the Programme; (c) administering and delivering the Programme, including communicating with you about the Programme and related opportunities and matching you with appropriate hotel partners and briefs; (d) monitoring and evaluating the performance of content created through the Programme, and sharing Programme Content publicly across Accor and hotel partner marketing channels (which may include crediting you by your social media handle); (e) analysing how users interact with the Programme platforms and improving the Programme experience; and (f) complying with our legal obligations.

9. Secondary purpose uses

We may use your personal information for a secondary purpose where you have provided your consent to that use during the course of, or in connection with, your participation in the Programme or performance of a Creator Partner Agreement. We will not use your personal information for any purpose unrelated to the Programme or any Creator Partner Agreement without your consent.

10. Disclosure of personal information

We may share your personal information with the following recipients: (a) Accor's affiliated entities, hotel partners and brands for the purposes of Programme delivery; (b) third-party service providers who assist us in delivering the Programme; and (c) any person or entity where required by law.

11. Disclosure of personal information overseas

As part of Accor's global operations, your personal information may be transferred to and processed by Accor entities and service providers located outside Australia, including in France, Singapore and other countries in Europe and the Asia-Pacific region. Where it is practicable to do so, we will identify the specific countries in which overseas recipients are likely to be located. Where your personal information is disclosed to an overseas recipient, Accor takes reasonable steps to ensure that the overseas recipient handles your personal information in a manner consistent with the Australian Privacy Principles.

12. Storage and security of personal information

We take appropriate technical and organisational measures to protect your personal information against illicit or accidental destruction, alteration, loss, misuse, and unauthorised access, modification or disclosure. To this end, we have implemented technical measures (such as firewalls) and organisational measures (such as user identification and password systems and means of physical protection) to ensure the ongoing confidentiality, integrity, availability and resilience of processing systems and services.

13. Retention and destruction of personal information

We retain your personal information for a reasonable period following the conclusion of your involvement in the Programme or, where applicable, the expiry or termination of any Creator Partner Agreement, or for such longer period as may be required by law or for business record purposes. We will endeavour to destroy or de-identify your personal information once it is no longer required for any of those purposes.

14. Accessing and correcting your personal information

Making a request: You may request access to the personal information we hold about you, and you may ask us to correct any personal information that is inaccurate, out of date, incomplete, irrelevant or misleading, by contacting us using the details set out in Section 15 below. There is no charge for making such a request, although we may recover reasonable costs associated with providing access, such as search and retrieval costs. We will respond to any request within 30 days of receipt.

Refusal of access: If we refuse a request, we will provide you with written reasons for doing so. Circumstances in which we may refuse access include where the request is frivolous or vexatious, where providing access would pose a threat to health or public safety, where it would unreasonably interfere with another individual's privacy, or where it would be unlawful or otherwise in breach of a law.
